Terms and Conditions for HomeEase

1. Acceptance of Terms

By accessing or using the HomeEase.co.nz website or HomeEase mobile application (collectively referred to as the “HomeEase platform”), you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms, you may not use the HomeEase platform.

If you are accessing the HomeEase platform on behalf of another party, you confirm that you are authorised to act on that party’s behalf, and agree to the terms and conditions on that party’s behalf. 

2. User Registration

To use certain features of the HomeEase platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

The HomeEase Platform is predicated on trust. To register on the HomeEase platform, you must:

  1. Be at least 18 years of age
  2. Be living in New Zealand 
  3. Provide full and accurate registration information
  4. Comply at all times with the terms and conditions

By registering for the HomeEase platform you confirm that you are at least 18 years of age, live in New Zealand, the information provided during registration is full and accurate and that you will comply at all times with the terms and conditions. 

Any user which does not meet any of these four criteria may have their account terminated without warning and may permanently lose access. At any time, HomeEase may request additional information from users to confirm details of age, location or to verify the completeness of already supplied information. HomeEase reserves the right to suspend a user’s account if they suspect any of the four criteria are not being met.

3. User Responsibilities

Users of the HomeEase Platform agree to:

a. Comply with all applicable laws and regulations.

b. Provide accurate and truthful information.

c. Respect the privacy and confidentiality of other users.

d. Use the Platform for lawful purposes only.

e. Refrain from harassing other users.

f. Not engage in 

  • Hate speech 
  • Bullying
  • Racial targeting
  • Or any behaviour which may cause offence, embarrassment or harm to any other user

Any behaviour that does not meet these standards may result in suspension or termination of the user’s account. 

4. Services

The HomeEase platform provides a platform for consumers to connect with businesses offering home services. The platform facilitates the transaction between consumer and business and may act as an intermediary for payment. However, HomeEase does not provide the services directly and is not responsible for the quality or fulfilment of the services. HomeEase will not be liable for any damages caused while a service is provided. See section 10.

By registering for the HomeEase platform, users which submit listings or respond to requests assert that the details they have provided are full and complete. Therefore, HomeEase is not liable for damages caused by misrepresentation on its platform. 

5. Listing on HomeEase

HomeEase provides a platform for users to list various home services. To make a listing, users must complete the registration process, provide some additional account information and then fill out all the necessary listing fields. 

Users which list a service on the HomeEase platform agree;

  1. All information provided is full and correct
  2. Information will be updated regularly to ensure it is accurate
  3. The lister is solely responsible for any work provided that originated from the listing and therefore, any damages sought against them for work that originated from the HomeEase platform
  4. The lister will pay a 5% commission to HomeEase on gross earnings 
  5. Once a transaction for the listers service is originated on the HomeEase platform (i.e. a response to any listing which came from HomeEase and led to a financial transaction), to carry out the transaction on HomeEase and not outside of the platform. 

In addition, the following behaviours relating to listings are considered against the terms and conditions of the HomeEase platform and may result in user suspension, termination or in serious cases, legal action: 

  1. Spamming listings which contain similar content. 
  2. Repeatedly reposting listings to boost them to the front of the listings page 
  3. Engaging in any form of harassment relating to a listing made by the user 
  4. Using inappropriate language or images as part of a listing 

6. Posting a request on HomeEase 

HomeEase provides a platform for users to post a request for a home service to be completed. In order to post a request, users must complete the registration process, provide some additional account information and then fill out all the necessary listing fields. 

Users which submit a request agree: 

  1. All information provide is full and correct
  2. Information will be updated regularly to ensure it is accurate
  3. They have genuine intention to hire someone for the task 
  4. To not misrepresent the task 
  5. Once a transaction for the request originated on the HomeEase platform (i.e. a response to the listing which came from HomeEase and led to a financial transaction), to carry out the transaction on HomeEase and not outside of the platform. 

In addition, the following behaviours relating to requests are considered against the terms and conditions of the HomeEase platform and may result in user suspension, termination or in serious cases, legal action: 

  1. Spamming requests which contain similar content. 
  2. Repeatedly reposting requests to boost them to the front of the listings page
  3.  Engaging in any form of harassment relating to a listing made by the user 
  4. Using inappropriate language or images as part of a listing 

7. Payment and Fees

The HomeEase Platform is free to use and register. However, HomeEase does charge commission for completed services and requests, offers paid premium listing and subscription options and may act as a financial intermediary for transactions. When payment for a transaction is facilitated outside of the HomeEase platform (i.e. the customer and the service provider arrange payment themselves), the commission charged by HomeEase still applies. For listings and requests, the commission rate is 5%. HomeEase will invoice businesses on a bi-weekly schedule and businesses must pay the required amount into the provided bank account within 30 days. If a booking is made by quote, businesses agree to provide accurate pricing information to HomeEase. HomeEase reserves the right to verify the correctness and completeness of this information and may contact the customer or seek other avenues of verification. Failure to pay invoiced amounts or embellishment of contract sizes may lead to fines, suspension or termination of accounts or legal action in extreme cases.

  1. Third party fees and charges. Users agree to the applicable fees and payment terms disclosed on the Platform. HomeEase has no control over, nor is not responsible for any additional charges or fees imposed by third-party payment processors. 

8. Dispute Resolution

Any disputes between users should be resolved directly between the parties involved. HomeEase is not responsible for mediating or resolving disputes but may provide assistance at its discretion.

9. Termination of Account

HomeEase reserves the right to suspend or terminate user accounts for violations of these terms.

10. Limitation of Liability

HomeEase is not liable for any damages, direct or indirect, arising from the use or inability to use the Platform, including but not limited to, incidental, consequential, or punitive damages.

12. Intellectual property

HomeEase owns all proprietary and intellectual property rights for the HomeEase platform, including all content posted to the HomeEase platform by external parties. 

Users of the HomeEase website agree not to challenge HomeEase’s ownership of any intellectual property relating to the HomeEase platform. Users also agree not to claim any intellectual property as their own, adapt the intellectual property for commercial gain or attempt to take ownership of the intellectual property through any legal process. Legal processes include but are not limited to: 

  1. Attempting to copyright HomeEase intellectual property
  2. Attempting to patent HomeEase intellectual property
  3. Attempting to trade mark or trade name HomeEase intellectual property
  4. Attempting to service mark HomeEase intellectual property

13. Privacy policy 

The HomeEase terms and conditions should be read and understood in conjunction with the HomeEase privacy policy. A link to the privacy policy is available: here

14. Reviews and comments

Upon completion of a service, users will have an opportunity to review the service provided by either a lister or a user who responded to a request. HomeEase reserves the right to: 

  1. Remove any feedback or reviews for any reason 
  2. Share select reviews and feedback to our social media channels and website 
  3. Edit or remove content that is deemed inappropriate or in conflict with the behavioural standards set out in these terms and conditions from feedback and reviews 
  4. Suspend or terminate users accounts based on inappropriate reviews or feedback, reviews or feedback which are not truthful in their representation or omit key details or context or reviews or feedback which are not in accordance with these terms and conditions. 

15. Changes to Terms and Conditions

HomeEase reserves the right to update or modify these terms and conditions at any time without prior notice. Users are encouraged to review the terms regularly.
